Sometimes as well as paying your own legal fees you reimburse someone else's too.
This might be because you are ordered by a court to reimburse them (look in the Courts and tribunals / Costs claims menu to read about that).
Or you may just agree to reimburse them (there may be no court proceedings involved anyway). Why would you agree to reimburse someone else's legal costs? Well, here are some examples:
- When a new lease or tenancy is entered into tenants sometimes agree to reimburse the landlord's legal fees as part of the deal.
- When a homeowner takes out a mortgage they usually have to reimburse the lender's legal fees. Often the lender will use the same solicitor as the borrower to do this work (if the solicitor is on its 'panel'); but it is still extra work that the lender has to pay for, so the lender insists that the borrower reimburses.
- When there is nothing in it for them. Say for example you wanted to buy a small part of your neighbour's garden to add to your own. Say you agreed a price of £500 with your neighbour. Your neighbour will have to pay legal fees, so there may be nothing in it for him. He may even make a loss! So why would he bother? If you really want it that much you would agree to reimburse his legal fees.
- People sometimes agree to reimburse someone else's legal costs as part of an agreed settlement of a dispute or court case.
