WHY USE US?

There are limits on costs that are recoverable against people who are litigating with the benefit of government funded Legal Aid.

As a general rule, to have been eligible for legal aid a person has to have passed a means tests, which would tend to mean that they cannot afford to pay their own legal fees.

Otherwise they would not have got legal aid.

That also however means that the chances are they will not be able to pay any legal fees to the other side if they lose the case. In principle there is no reason why they cannot be ordered to the same as everybody else. However costs orders cannot be enforced against people on legal aid without a specific enquiry into that person's means by the court.

On the other side of the coin however, it is occasionally possible to request an order that the legal aid authorities themselves pay the costs instead of the legally aided person. These applications are rare, but they do happen from time to time.
