You do not need to have suffered any injury leakage or breakage at all to make a claim. If your implants are defective you are entitled to make a claim NOW, you do not need to wait until something goes wrong with them.
The law: If something you buy is defective you are entitled to your money back and/or compensation as well. That applies to breast implants the same as anything else. You do not need to have suffered from it, though if you have you could get more compensation as a result.
Time limits: generally either six years from the date of the surgery or three years from when you knew you had an injury, whichever is later. Even if you were injured earlier and never knew it was to do with the breast implant until later, your three years runs from the later date when you found out about it.
Even after the time limit expires you might still be able to make a late claim. This is not always possible though so don't chance it, and if you do, the sooner the better.
