Bankruptcy proceedings are started by service of, what is known as a statutory demand, which in effect demands payment of the full debt within 21 days, then if it is not paid within that time you are then entitled to apply to the court to have them made bankrupt.
Once they are bankrupt then the official receiver or trustee in bankruptcy will manage their affairs, including ensuring that your debt is paid provided of course there is enough money to pay it.
