WHY USE US?

The courts have, what they call the 'Overriding Objective'. This is simply the objective of dealing with cases fairly without too much technicality and without trying to tie everybody up in paperwork and complexity.

As part of behaving in accordance with the overall overriding objective, parties are expected, for example, to

  • - consider dealing with disputes otherwise than by bringing them to court

  • - to make reasonable concessions about their case to each other

  • - try to make offers to settle the dispute

  • - and generally deal with things in a proportionate manner without getting too angry about anything.

Judges expect the parties to behave in conducting their claims and defences in accordance with this overriding objective, and if they do not then they come under criticism and may find themselves being penalised by adverse costs crders.
