It is often believed that the fact that somebody is employed through an agency means that they do not have any employment rights. This is not necessarily correct.
The employment rights legislation is compulsory, it cannot be gotten round by simply using the device of employing somebody through an agency rather than directly. That however does not necessarily mean either that every single agency arrangement is a sham and will be ignored from the point of view of employment protection law. It all depends on the precise agency agreement concerned and how it works in practice.
